Terms and Conditions for Training Services provided by Teresa Sousa.
I, Teresa Gonçalves de Sousa, trading as TAGS - Language Solutions, am engaged in providing training services including, but not limited to, online courses and/or taught courses (“the Service”). I will provide the Service according to the Terms and Conditions (“Terms”) set out below.
Any Service that you purchase from me is subject to these Terms, and the Client acknowledges having read and accepted them.
This document sets out the Terms for using the Service. It also sets out other important things that you need to know. These Terms apply to the sale of any training services. Please read these Terms carefully before purchasing any training and print off a copy for your records. For purchases via my website, by clicking on the “Accept” button, you agree to these Terms, which will be binding on you. If you do not agree to these Terms, you must cease to purchase any Services from me.
These Terms form a legal agreement (“the Agreement”) between:
you, the Client and
me, Teresa Sousa, trading as TAGS - Language Solutions.
Please note that throughout this Agreement, “I” and “my” refers to Teresa Sousa and “you”, “your”, and “yours” refer to you, the Client. I may refer to you and I collectively as “we” or “us”.
Why do we need these terms?
These Terms are the basis on which I perform the Service for you. You need to understand these Terms to understand what our obligations are to each other and ensure a good working relationship. These Terms are written in plain English.
These Terms are the basis for any contractual relationship made between us, whether written or oral, and whether these Terms are expressly mentioned or not.
What Services can you purchase from me?
A description of the Services, together with the dates on which the Services will be provided, are available on my website. I will provide the Services with reasonable care and skill in line with the description set out on my website (https://tagslanguagesolutions.com/seo-translation-training/).
I reserve the right to vary or withdraw any of the Services described on the website without notice.
I expect you to confirm that the Services you are purchasing will meet your needs. I do not guarantee that you will obtain a particular result, professional qualification, or employment opportunity from your purchase and completion of any of the Services.
When you purchase a Service from me, any content and links provided to you are for your sole use, and these should not be shared with any third parties. Any content or links provided as part of the Service may only be shared with third parties who I have authorised in advance in writing via email.
Delivery of the Service
The Service is delivered using a third-party platform agreed upon by us, and I make no representation that the operation of the Service will be uninterrupted or error-free, and I am in no way liable for any interruptions to the Service, including but not limited to malfunctions, errors etc.
Can you keep a secret?
We need to keep things between us. Any content provided before, during or after the Service must not be disclosed to anyone else. This includes but is not limited to material and links to resources and recordings as part of the Service. I’ll never disclose any aspect of our Agreement or the Service I provide to you without your written consent.
You shall be bound by this confidentiality regardless of the termination of these Terms.
Intellectual property
All intellectual property rights in the materials, online courses and the speeches made by trainers as part of the Service are and remain my intellectual property. Any content provided before, during and after the Service is owned by me. Unless otherwise agreed in writing, I retain the rights to all of my creations (linguistic, graphic or any other).
You are not authorised to:
copy, modify, reproduce, re-publish, sub-licence, sell, upload, broadcast, post, transmit or distribute any of the Service content without prior written permission.
record on video or audio tape, relay by videophone or other means the Service provided.
use the Service content in the provision of any other course or training.
remove any copyright or other notice of Teresa Sousa or TAGS - Language Solutions on the Service content.
modify, adapt, merge, translate, disassemble, decompile, reverse engineer (save to the extent permitted by law) any software forming part of the Service.
In consideration of the Fees paid by you, I grant you a limited, non-transferable, non-exclusive licence to use the Service content and the software in respect of the Service for the sole purpose of using or attending the Service.
Who is liable?
Neither of us will, under any circumstances whatsoever, be liable to the other, whether in contract, tort (including negligence) or restitution, or for breach of statutory misrepresentation or otherwise, for any:
loss of profit,
loss of goodwill,
loss of business,
loss of business opportunity,
loss of anticipated saving,
loss of corruption of data or information, or
special, indirect, or consequential damage suffered by the other party that arises as part of or in connection with these Terms.
Without prejudice to the above, my total liability arising as part of or in connection with these Terms, whether in contract, tort (including negligence) or restitution, or for breach of statutory misrepresentation, or otherwise, will in all circumstances be limited to the amount of the Fee for the Service.
Entire Agreement
This Agreement forms the entire agreement between you, the Client and me, Teresa Sousa, trading as TAGS - Language Solutions. This Agreement supersedes any prior agreements and communications between us to this Agreement, whether oral or written. You confirm that you have not relied on any representations in entering into these and any other terms and conditions with TAGS - Language Solutions. Nothing in these Terms shall limit liability for any fraudulent misrepresentation.
If any provision of this Agreement is held to be invalid or unenforceable, that provision shall be eliminated or limited to the minimum extent necessary such that the parties’ intent is effectuated, and the remainder of this Agreement shall have full force and effect.
Which law applies to our legal relationship?
Belgian law will apply to this legal agreement, and you agree to submit to the exclusive jurisdiction of the Belgian courts.
By enrolling in the course, you confirm you have read and agreed to the Terms of this Agreement.
